1. Scope

These General Terms and Conditions (GTC) apply to all contracts concluded between customers and eQuisto Customized Commerce GmbH, eQuisto GmbH, Gehrtsstrasse 14, 40235 Duesseldorf (hereinafter referred to as “eQuisto”) via the online shop at www.feathershade.com. The version valid at the time of contract conclusion shall apply.

Different terms and conditions of the customer are not recognized unless eQuisto expressly agrees to their validity in writing.

2. Contractual Partner

The purchase contract is concluded with eQuisto, registered in the commercial register of the Duesseldorf Court under HRB 40954, VAT ID: DE217116068.

3. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding online catalog. By clicking the “Buy now” button, you submit a binding order for the goods contained in your shopping cart. Confirmation of receipt of your order occurs together with the acceptance of the order immediately after sending through an automated email. With this email confirmation, the purchase contract is concluded.

4. Prices and Shipping Costs

The prices stated on the product pages include statutory value-added tax and other price components. In addition to the stated prices, shipping costs may apply. You can find more information about shipping costs under Shipping & Delivery.

5. Delivery Conditions and Self-Supply Reservation

Delivery is only within the specified countries.

If not otherwise stated in the product description, the delivery time is 3–7 business days.

Should the delivery of the goods fail due to your fault despite three delivery attempts, eQuisto can withdraw from the contract. Any payments made will be refunded immediately.

If the ordered product is not available because eQuisto is not supplied with this product by its supplier through no fault of its own, eQuisto may withdraw from the contract. In this case, you will be informed immediately, and, if applicable, the delivery of a comparable product will be suggested. If no comparable product is available or you do not wish a comparable product to be delivered, any payments made will be refunded immediately.

6. Payment

Payment can be made by credit card, PayPal, invoice (via Klarna), or other available payment methods listed during the order process.

eQuisto reserves the right to exclude certain payment methods for first-time orders or depending on the delivery country and to refer to other payment methods.

7. Retention of Title

The goods remain the property of eQuisto until full payment is made.

8. Right of Withdrawal

Consumers have a statutory right of withdrawal.

9. Warranty

Legal warranty rights apply to all goods from our shop. Further information about any additional warranties and their exact conditions can be found on the product pages and special information pages in the online shop.

10. Liability

eQuisto is liable for intent and gross negligence. Furthermore, eQuisto is liable for the negligent breach of obligations whose fulfillment makes the proper execution of the contract possible in the first place, whose violation endangers the achievement of the purpose of the contract, and on whose compliance you may regularly rely. In the latter case, eQuisto is only liable for foreseeable, contract-typical damages. The same applies to breaches of duty by agents.

The aforementioned exclusions of liability do not apply in case of injury to life, body, and health. Liability under the Product Liability Act remains unaffected.

11. Final Provisions

Contracts between eQuisto and the customer are subject to the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies to the extent that it does not withdraw the protection granted by mandatory provisions of the law of the state in which the consumer has their habitual residence.

If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and eQuisto is the registered office of eQuisto.
